Terms of Service
These Terms of Service (“Terms”) govern access to and use of Harbour (getharbour.io and related applications), operated by the legal entity doing business as Harbour (“Harbour”, “we”, “us”). By creating an account or using the service, you agree to these Terms.
Beta service
Harbour is offered as a closed or limited beta. Features may change, break, or be withdrawn without notice. We do not warrant uninterrupted or error-free operation during beta. Do not rely on Harbour as your sole system of record for mission-critical data until you have confirmed durability and backups for your use case.
The service
Harbour provides software for digital agencies to operate workspaces, CRM, sites, automations, communications, and related workflows. Some capabilities (SMS, payments, public forms, campaigns, marketplace, and public APIs) may be disabled until compliance and safety controls are ready.
Accounts and workspaces
You are responsible for activity under your account, for keeping credentials secure, and for ensuring that teammates you invite are authorized. You must provide accurate business information when required. Public self-serve registration may be disabled; access may be by invitation only.
Subscriptions, renewal, cancellation, refunds
Paid plans, if offered, are billed through Stripe. Fees, renewal intervals, and taxes are described at purchase or in your order form. Until Harbour’s in-app billing is enabled, subscriptions may be sold via a Stripe-hosted Payment Link outside the product. Cancel according to the Stripe customer portal or your order form. Beta fees are generally non-refundable except where required by law or expressly stated at purchase.
Acceptable Use Policy
You may not use Harbour to:
- Send spam, unlawful, deceptive, or harassing communications
- Violate carrier, Twilio, Stripe, email provider, or CASL / anti-spam rules
- Probe, overload, or abuse APIs, forms, or shared infrastructure
- Upload malware or infringe others’ intellectual property
- Process special-category data without a lawful basis and appropriate safeguards
- Resell access without our written permission
We may suspend or terminate accounts that violate this policy or create risk for Harbour or other customers.
Messaging and payments compliance
SMS and voice identity verification are performed by Twilio. You submit business information directly to Twilio through their hosted compliance experience when those features are enabled. Harbour does not store your business registration documents for that purpose and does not act as the messaging brand of record for your traffic. Payment processing is handled by Stripe.
Customer content
You retain ownership of content you submit. You grant Harbour a limited license to host, process, and display that content solely to provide the service. You represent that you have the rights and consents needed to process personal information of your clients and contacts.
Data export and deletion
You may request export or deletion of workspace data by emailing privacy@getharbour.io. We will respond within a reasonable period and delete or anonymize data that is no longer required, subject to legal retention needs (billing, security logs, dispute records).
Confidentiality and security
We implement administrative and technical safeguards appropriate to a multi-tenant SaaS product. No method of transmission or storage is fully secure. Report suspected vulnerabilities to security@getharbour.io.
Disclaimers and limitation of liability
THE SERVICE IS PROVIDED “AS IS” DURING BETA. TO THE MAXIMUM EXTENT PERMITTED BY LAW, HARBOUR DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. OUR AGGREGATE LIABILITY ARISING FROM THE SERVICE IS LIMITED TO THE FEES YOU PAID TO HARBOUR IN THE THREE MONTHS BEFORE THE CLAIM (OR CAD $100 IF GREATER AND NO FEES WERE PAID).
Governing law
These Terms are governed by the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. Courts in Halifax, Nova Scotia have exclusive jurisdiction, except where consumer protections require otherwise.
